Mediation Philosophy
Truly effective mediators do more than shuttle offers between parties—they assess the strengths and weaknesses of each side’s position and help both parties realistically evaluate their trial risk.
Throughout his decades as a civil litigator, Norman has participated in dozens of mediations across False Claims Act matters, medical malpractice disputes, and other complex civil cases. These experiences have given him a clear understanding of what distinguishes a skilled mediator from a merely adequate one.
The most successful mediators act as thoughtful advisors. They help each side recognize the vulnerabilities in their own case while also appreciating the legitimate concerns of the opposing party. They are patient—understanding that meaningful progress often requires difficult concessions—and they are persistent, guiding the parties forward even when negotiations stall.
A productive mediation often ends with both sides feeling they compromised more than they expected, yet confident in the fairness and stability of the outcome. Norman’s role as mediator is to help the parties reach that point: a resolution they can accept, understand, and ultimately feel comfortable with.
